Terms of Service

By accessing or using Property Overseer ("the Service"), operated by Property Overseer LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. We reserve the right to update these terms at any time, and continued use of the Service constitutes acceptance of any changes.

Property Overseer is a web-based evidence documentation platform that allows users to create evidence files, capture photo evidence directly from their device camera, and export Certified Records built to a court-admissible standard. To preserve timestamp integrity, evidence photos must be captured live through the in-app camera — uploads from a photo library are not permitted. Each sealed phase of evidence is hashed with SHA-512 and timestamped by an independent RFC 3161 Time Stamp Authority (TSA), and all files are stored in Cloudflare R2 with their signed timestamp tokens preserved alongside them.

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate, current, and complete information during registration. You must be at least 18 years old to use the Service.

The Service is available via paid subscription plans and a pay-per-export option: • Basic Plan: $29 per month — 5 evidence files per month. • Plus Plan: $59 per month — 15 evidence files per month. • Premium Plan: $99 per month — 40 evidence files per month. • Certified Record export: $50.00 per Certified Record — no subscription required, account required. Monthly evidence file allocations reset each billing cycle and do not roll over. All payments are processed through Stripe. Prices are in USD and may be subject to applicable taxes. We reserve the right to change pricing with 30 days' written notice to subscribers.

Evidence captured through Property Overseer is stored in Cloudflare R2. When you seal a phase of evidence, the files are hashed with SHA-512 and the resulting batch hash is submitted to an independent RFC 3161 Time Stamp Authority (TSA), which returns a cryptographically signed timestamp token. This token is preserved alongside your evidence and can be independently verified (for example, with standard OpenSSL tooling), providing cryptographic proof that the evidence existed in its exact form at the sealed moment and has not been altered since. While we make every effort to maintain the integrity of your evidence, Property Overseer does not guarantee the admissibility of evidence in any court or legal proceeding. Admissibility is determined by the presiding court or authority.

You agree not to use the Service to: upload illegal, fraudulent, or harmful content; misrepresent, fabricate, or tamper with evidence; violate any applicable laws or regulations; attempt to circumvent security measures, integrity verification, or access controls; use automated systems or bots to access the Service; or interfere with the operation of the Service or its infrastructure.

You retain ownership of all content you upload to the Service. By uploading content, you grant Property Overseer a limited, non-exclusive license to store, process, and display your content solely for the purpose of providing the Service. The Property Overseer name, logo, design, and all related trademarks are the property of Property Overseer LLC.

Your uploaded files are stored securely in Cloudflare R2 infrastructure. We take reasonable measures to protect your data, but no system is completely secure. Please review our Privacy Policy for full details on how we collect, use, and protect your information. We do not sell your personal data or evidence to third parties.

Certified Records are document bundles built to a court-admissible standard, containing your evidence records, SHA-512 integrity hashes, RFC 3161 timestamp details, and evidence file metadata. For users without an active subscription, each Certified Record export costs $50.00 per packet; active subscribers have exports included in their plan. Certified Records are generated on-demand and delivered digitally. Once a Certified Record is generated, the export fee is non-refundable.

Property Overseer is provided "as is" and "as available." We make no warranties, express or implied, regarding the Service's fitness for a particular purpose, accuracy, or reliability. To the maximum extent permitted by law, Property Overseer LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of evidence, or adverse legal outcomes.

We may suspend or terminate your account at any time for violation of these terms or for any reason at our discretion. You may cancel your subscription at any time through your account settings. Upon cancellation, you retain access through the end of your current billing period. After termination, we may retain your data for up to 90 days before permanent deletion, unless required by law.

These Terms of Service are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved in the state or federal courts located in New York County, New York.
